Welcome to River Otter Kayak Adventures! Please read the following Terms and Conditions carefully, as they govern your participation in our kayak trips. By booking with us, you agree to the following terms:

1. Rental Agreement

• Eligibility: Renters must be at least 18 years old and provide a valid photo ID. Renters under 18 must have a legal guardian sign on their behalf.
• Equipment Care: Renters are responsible for the care and proper use of all rented equipment, including kayaks, paddles, life jackets and any other accessories provided. Any loss, theft, or damage beyond normal wear and tear will be charged to the renter.
• Safety Gear: Renters are required to always wear life jackets (PFD’s) while on the water

2. Assumption of Risk

• Kayaking and related activities involve inherent risks, including but not limited to changing weather conditions, water currents, wildlife encounters, and other natural hazards. Renters assume all responsibility for their safety and agree to participate at their own risk.
• River Otter Kayak Adventures Ltd. Is not liable for any personal injury, loss, or damage to personal property during your rental or shuttle experience.

3. Shuttle Services

• Shuttle reservations must be made in advance. We are not responsible for delays caused by traffic, weather, or other unforeseen circumstances.
• Customers must arrive on time for their scheduled shuttle. Late arrivals may result in forfeiture of the shuttle fee.
• Shuttle fees are non-refundable except in cases where River Otter Kayak Adventures Ltd. cancels the service.

4. Reservations and Cancellations

• Full payment must be made at time of online booking.
• Cancellations must be made at least 48 hours in advance to receive a refund. Cancellations made after this window will result in a 20% fee.
• Late arrivals may be considered a no-show and be charged full price.
• River Otter Kayak Adventures Ltd. reserves the right to cancel or reschedule rentals or shuttles due to unsafe weather conditions, low or high water levels or other factors beyond our control. In such cases, customers will be rescheduled or provided a full refund/credit.

5. Prohibited Activities

• Renters and shuttle passengers must not:
  • Use drugs or consume alcohol during the rental or shuttle period.
  • Engage in reckless or unsafe behavior that endangers themselves, others, or the equipment
  • Remove equipment from designated areas or use it for unauthorized activities

6. Acknowledgment of Rules and Guidelines

• Renters and shuttles passengers must follow all local laws and waterway regulations, and instructions provided by River Otter Kayak Adventures Ltd. staff.
• Failure to comply with these terms may result in immediate termination of the rental or shuttle service without a refund.

7. Waiver and Release

• All renters and passengers are required to sign a waiver of liability before participating. Minors must have a parent or legal guardian sign on their behalf.

8. Privacy Policy

• Personal information collected during booking is used solely for operational purposes and will not be shared with third parties.

9. Changes to Terms

River Otter Kayak Adventures Ltd. reserves the right to update the terms and conditions at any time. Updates will be posted on our website.
